Classification of working conditions
Classifying workers according to working conditions is the process of identifying and grouping jobs or occupations based on the factors and working conditions that workers or employees must meet. Classifying labor according to working conditions helps create a standardized and uniform system in labor evaluation and management.
1. Purpose of classifying workers according to working conditions
According to the provisions of Clause 2, Article 4, Circular No.: 29/2021/TT-BLDTBXH: Classification of workers according to working conditions is the responsibility of the employer to implement labor protection regimes and health care for workers according to the provisions of Clause 3, Article 22 of the Law on Occupational Safety and Hygiene.
In addition, the classification of workers according to working conditions also has the purpose of building, amending, supplementing or removing from the List of occupations, heavy, hazardous, dangerous jobs and occupations, especially heavy jobs. , toxic and dangerous according to Circular 11/2020/TT-BLDTBXH.
2. Any enterprise is required to classify workers according to working conditions
According to the provisions of Clause 1, Article 10, Circular No. 29/2021/TT-BLDTBXH, the classification of working conditions must be done at least once within 5 years:
The employer reviews, evaluates, and classifies workers for the first time and when there are changes in technology and production organization processes that lead to changes in working conditions.
When conducting a risk assessment on occupational safety and hygiene according to the provisions of the Law on Occupational Safety and Hygiene and detecting new dangerous and harmful factors that have arisen compared to the previous assessment. but must ensure review and evaluation.
3. So how many types of working conditions are there?
According to the provisions in Clause 1, Article 3, Circular No.: 29/2021/TT-BLDTBXH, there are these types of working conditions:
Occupations and jobs that are particularly heavy, harmful, and dangerous are occupations and jobs with working conditions classified as V or VI.
Heavy, hazardous and dangerous occupations and jobs are occupations and jobs with working conditions classified as class IV.
Occupations and jobs that are not heavy, non-toxic, and non-dangerous are occupations and jobs with working conditions classified as I, II, III.
4. Process and method of evaluating and determining working conditions according to Circular 29/2021-BLDTBXH.
Pursuant to Article 6, Circular 29/2021/TT-BLDTBXH, evaluating and determining working conditions according to the following process:
Determine the name of the profession or job that needs to be evaluated to determine working conditions.
Evaluate working conditions according to regulations in the circular.
Step 1: Identify factors that have a biological impact on workers in the indicator system on working conditions specified in Appendix I according to Circular 29/2021/TT-BLDTBXH.
Step 2: Select at least six characteristic factors (possibly more than 6 factors) corresponding to each profession and job. These factors must ensure that they fully reflect all three groups of labor environmental hygiene, labor psychology and ergonomics - labor organization in the system of indicators on working conditions specified in Appendix I.
Step 3: Choose one indicator for each characteristic factor that the evaluation unit selected in Step 2 to evaluate and score.
Step 4: Based on the analysis and evaluation of test results to calculate the average score of the factors.
Step 5: Summarize results and determine working conditions according to Circular 29/2021-BLDTBXH.
